Title IX Grievance Procedures
Districts “shall adopt and publish grievance procedures providing for prompt and equitable resolution of student and employee complaints alleging any action which would be prohibited” by Title IX or its regulations (34 CFR Section 106.8[B]).
Title IX Grievance Required Elements
- Notice to students, parents, and employees regarding the grievance procedures, including where complaints may be filed.
- Application of procedures to complaints alleging sexual harassment by staff, other students, or third parties.
- Adequate, reliable, and impartial investigations of complaints (including the opportunity to present witnesses and other evidence).
- Designated and reasonably prompt time frames for the major states of complaint process.
- Written notice to parties of the outcome of the complaint.
- Assurance that the district will take steps to prevent recurrence of any harassment and correct its discriminatory effects on the complainant and others, if appropriate.
- Notice that complainant can end an informal resolution process at any time
